These Terms and Conditions ("Terms") govern the use of services provided by the Graton Day Labor Center / Centro Laboral de Graton ("CLG," "we," "our," or "us") for employers seeking to hire workers. By requesting or hiring workers through CLG, you agree to comply with and be bound by these Terms.
1. Role of CLG
CLG is a nonprofit organization that facilitates connections between employers and available workers. CLG does not employ the workers unless explicitly stated in writing for a specific program. Workers are generally independent workers or participants in CLG programs.
2. Employer Responsibilities
By hiring through CLG, employers agree to:
Provide accurate and complete information about the job, including duties, location, hours, pay rate, and tools required.
Provide a safe, lawful, and respectful work environment.
Comply with all applicable local, state, and federal labor laws.
Pay the agreed-upon wages in full and on time, as outlined by CLG prior to job dispatch.
Treat all workers with dignity and without discrimination, harassment, or retaliation.
3. Wages and Payment
Pay rates are established prior to dispatch and may vary based on job type, risk level, tools required, or number of workers.
Payment is due immediately upon job completion unless otherwise agreed in writing.
Failure to pay as agreed may result in denial of future services.
4. Cancellations and Minimum Charges
Employers must provide reasonable notice for job cancellations.
Same-day cancellations or no-shows may be subject to a minimum charge.
If a job ends early without cause, minimum hour requirements may still apply.
5. Safety and Tools
Employers are responsible for providing all required tools unless otherwise specified.
Employers must ensure that equipment provided is in safe working condition.
Workers have the right to refuse unsafe work.
6. Worker Conduct and Performance
If an issue arises with worker performance, employers must notify CLG as soon as possible.
CLG will make reasonable efforts to address concerns but does not guarantee replacement workers.
7. Liability and Indemnification
Employers assume responsibility for the worksite and job conditions.
CLG is not liable for damages, losses, or injuries occurring at the job site, except as required by law.
Employers agree to indemnify and hold harmless CLG from claims arising out of the employer’s job or worksite conditions.
8. Non-Discrimination Policy
CLG maintains a strict non-discrimination policy. Employers may not request workers based on race, ethnicity, gender, immigration status, religion, sexual orientation, or other protected characteristics.
9. Termination of Services
CLG reserves the right to refuse or terminate services to any employer who violates these Terms or acts in a manner inconsistent with CLG’s mission and values.
10. Changes to Terms
CLG may update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
